AvAI Messaging Terms & Conditions

These Messaging Terms & Conditions ("Terms") govern the text-message (SMS) safety-alert program of AvAI, a backcountry safety companion service operated by Rocky Mountain Digerati, LLC ("RMDig", "we", "us", "our"). By providing a mobile number to AvAI or by replying YES to an AvAI check-in partner request, you agree to these Terms and to our Privacy Policy.

AvAI is a safety companion, not an emergency service. AvAI does not contact 911 or dispatch rescuers on your behalf, and message delivery is never guaranteed. Do not rely on AvAI as your only safety system. If someone is in danger, call your local emergency number (911 in the U.S.) directly. AvAI is currently offered as a beta service and may have outages of hours or days.

1. The AvAI messaging program

AvAI lets a person ("Account Holder") ask another person ("Check-In Partner") to keep watch over a backcountry outing. When an Account Holder "checks out" for an outing and does not "check in" by their planned return time, AvAI's servers send a safety alert by SMS (and, where available, email) to the Check-In Partner the Account Holder designated. The Account Holder may also trigger an immediate "Send Help" alert.

2. Who receives messages

  • Check-In Partners. If an Account Holder lists you as their Check-In Partner, AvAI sends you a one-time request to confirm you are willing to receive alerts. You receive ongoing alerts only after you opt in.
  • Account Holders. You may receive transactional messages related to your own account and outings.

3. Types of messages you may receive

  • A consent request inviting you to become a Check-In Partner.
  • A per-outing availability request when an Account Holder checks out.
  • A check-in-missed (overdue) alert, which may include the Account Holder's last known coordinates and a local search-and-rescue contact number when one is known.
  • An escalation alert if the Account Holder remains overdue.
  • A "Send Help" emergency alert triggered by the Account Holder.
  • A retraction notice if an alert was a false alarm, and follow-up updates (for example, a search-and-rescue contact identified after the first alert).

4. Message frequency

Message frequency varies and depends on Account Holder activity. The program is recurring: outside of active outings you should expect few or no messages, while during an overdue or emergency situation you may receive several messages in a short period.

5. Cost

Message and data rates may apply. AvAI does not charge you for messages, but your mobile carrier may, according to your plan. Contact your carrier for details.

6. How to opt in (consent)

When an Account Holder lists you as their Check-In Partner, you receive a request such as: "AvAI: [name] has asked you to be their check-in partner... Reply YES to accept or NO to decline." Replying YES opts you in to receive safety alerts for that Account Holder. You are not enrolled until you opt in.

7. How to opt out

Reply STOP to any AvAI message at any time to stop receiving messages. After you send STOP, AvAI will send one confirmation message and will not send further messages unless you opt in again.

Because a Check-In Partner provides safety coverage for a real person, if you opt out while an Account Holder is relying on you, AvAI will notify that Account Holder so they can arrange other coverage. To protect people in an active rescue, the STOP instruction is included on the opt-in request and is not repeated inside live emergency alerts; carrier-level STOP handling continues to work on every message regardless.

8. How to get help

Reply HELP to any AvAI message for assistance, or email [email protected]. AvAI support cannot dispatch emergency services; in an emergency, call your local emergency number directly.

9. Delivery and carriers

AvAI sends messages through third-party telecommunications providers and mobile carriers. Messages may be delayed or fail to deliver for reasons outside our control, including carrier issues, network outages, device settings, and roaming. Carriers are not liable for delayed or undelivered messages. AvAI does not guarantee that any message will be delivered, read, or acted upon.

10. Eligibility and acceptable use

You must be able to form a binding agreement and provide a mobile number you are authorized to use. You agree not to use AvAI messaging unlawfully, to harass others, or to designate a phone number you do not have permission to contact. Account Holders are responsible for ensuring they have permission to list a person as a Check-In Partner.

11. No warranty; limitation of liability

AvAI messaging is provided "as is" and "as available," without warranties of any kind to the maximum extent permitted by law. To the maximum extent permitted by law, Rocky Mountain Digerati, LLC is not liable for any indirect, incidental, or consequential damages, or for any harm arising from delayed, undelivered, or unread messages, or from reliance on AvAI in place of established safety practices and emergency services.

12. Changes to these Terms

We may update these Terms from time to time. Material changes will be reflected by the "Last updated" date above. Your continued use of AvAI messaging after a change means you accept the updated Terms.
